If we determine that your claim needs to be filed as a lawsuit, we have three years from the date of injury to file the lawsuit.

Should I just deal with my insurance provider?

Insurance companies have a vested interest to pay out as few claims as possible, while
maintaining high premiums. Because of this, Insurance companies oftentimes attempt to minimize
your claim for THEIR benefit. They will attempt to try to convince you to settle your claim at
the beginning of the process. As explained above, settling at the beginning is NOT in your best

Am I entitled to compensation if I am partly at fault?

Rhode Island uses what is called a Pure Comparative Negligence Standard to determine damages. With this system, the damage award is allocated to reflect the percentage of fault for all parties involved. Therefore, an accident can be 70% your fault, and we will still fight to get you full value (30% of the total value in this example) of your claim from the other drivers insurance company. This can result in very complex negotiation, so having an experienced attorney to represent you through the process is essential.
